1. Acceptance of Terms

By accessing or using the PulseSeal platform, services, and associated hardware devices (collectively, the "Services") provided by Palm Technologies Private Limited ("PulseSeal," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization.

2. Service Description

PulseSeal provides quantum-resistant biometric authentication and encrypted data vault services for enterprise use. The platform uses palm vein recognition to derive cryptographic keys for securing sensitive data. Services include cloud-hosted and on-premise deployment options, hardware scanner devices, and administrative tools.

3. Subscription and Pricing

PulseSeal offers subscription plans on a per-location-premise basis. The Starter plan supports up to 20,000 users per location at $49 per month. The Unlimited plan supports unlimited users per location at $99 per month. Pricing may be updated with 30 days advance notice. All fees are non-refundable except as required by applicable law.

4. User Responsibilities

You are responsible for maintaining the security of your account, safeguarding your Palm device hardware, ensuring authorized use within your organization, complying with applicable laws and regulations in your jurisdiction, and providing accurate registration information.

5. Data Ownership

You retain full ownership of all data stored in your PulseSeal vaults. We do not access, analyze, or monetize your encrypted data. For on-premise deployments, all data remains within your infrastructure. Upon subscription termination, you may export your data within 30 days.

6. Intellectual Property

The PulseSeal platform, software, hardware designs, documentation, and brand assets are the intellectual property of Palm Technologies Private Limited. You are granted a limited, non-exclusive, non-transferable license to use the Services during your subscription period.

7. Limitation of Liability

To the maximum extent permitted by applicable law, PulseSeal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

8. Termination

Either party may terminate the subscription with 30 days written notice. We may suspend access immediately in cases of security breach, violation of these terms, or non-payment. Upon termination, you have 30 days to export your data before it is permanently deleted.

9. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
